Peabody Planning Board Grants Conditional Lot Release for Stonegate Subdivision

PEABODY — October 19, 2023 — Peabody Planning Board clears Stonegate subdivision lots under engineering conditions. The board voted unanimously Thursday to grant a conditional release of all lots in the Stonegate subdivision to developer Peabody Living, LLC, requiring a surety bond to be in place and compliance with three conditions set by Director of Public Services William Pollitz in an October 19 memo. D'Andra DiBiase, appearing for the developer, secured a modification to one condition: rather than providing retaining-wall as-built plans for lots 16 and 17 before those lots are released, no building permit will issue for those two lots until the as-builts are filed. Staff said Director Pollitz expected to confirm compliance "within a week." The board also deferred a vote on formally clarifying the Mullen rule — governing when a member may vote after missing a meeting — and directed staff to seek a written opinion from the city solicitor on whether the state statute's reference to "adjudicatory hearings" covers the board's ongoing site plan review sessions.
